This Agreement is a contract between you, the Customer, and the International Beer Shop Pty Ltd ACN 153 974 997, Licence number 6030004358, trading as the International Beer Shop.

Under Australian law, alcoholic beverages can only be sold or supplied to persons over the age of 18 years.

Set out below, are the Terms & Conditions under which you may purchase products online from the International Beer Shop.

Please read the following Terms & Conditions carefully before placing your order.

By completing the online order form and using the International Beer Shop services, you the Customer agree to be bound by the Terms & Conditions set out in this Agreement.

Interpretation

Set out below, are the Terms & Conditions under which you may purchase products online from the International Beer Shop.

By completing the online order form and using the International Beer Shop services, you the Customer agree to be bound by the Terms & Conditions set out in this Agreement.

Agreement

The Agreement is between you and the International Beer Shop for goods purchased via the website, subject to these conditions and any terms associated with the online order.

An Agreement exists between you and International Beer Shop once an online order form is received and accepted at its licensed premises. No obligation to sell or supply the goods will arise until then. Each online order form will be treated as a separate Agreement.

If money is owed to International Beer Shop under one Agreement, International Beer Shop reserves the right to offset that money against any money that you owe, or it owes you under another Agreement.

Each provision of this Agreement (including these Conditions) are severable. Severance does not affect any other provisions.

Ordering

Please note, orders can only be accepted with an Australian Delivery Address at this time.

You must complete the online order form in full. You warrant that all information provided by you is accurate, complete and current. You will promptly inform International Beer Shop if there is any change to this information.

In order to purchase goods from International Beer Shop, the delivery address that you nominate will need to be within an area where International Beer Shop provides delivery services. You will be notified if you nominate an area that is not covered.

An order can be submitted by completing and sending the online order form, email, post, and fax or by telephone.

International Beer Shop will use its best endeavours to ensure that all goods ordered by you are supplied. If any are not readily available, you will be offered a suitable substitute prior to completing any order.

Delivery

International Beer Shop is required to obtain written authorisation via e-mail or fax transmission to deliver goods to the address supplied. The goods can be delivered without obtaining a receipt of goods delivered, unless previously instructed to do so by the purchaser.

If the order stipulates special instructions for delivery, then International Beer Shop will do its best to adhere to those instructions. International Beer Shop, and all couriers, delivery companies acting for and behalf of the International Beer Shop, will take all due care and reasonable precautions to ensure the order is delivered correctly and in good condition.

International Beer Shop will take no responsibility for incorrect delivery details provided by you, or any liability for goods delivered to the Delivery Address but not received by you.

Anyone at the delivery address, who receives the goods, shall be presumed to be authorised to receive the goods. The International Beer Shop may request that the person who receives the goods at the Delivery Address provide satisfactory evidence of proof of age and sign their name for receipt of receiving the goods.

If this person is unable or unwilling to provide evidence of proof of age, the goods will not be delivered.

If you the Customer fail to notify the International Beer Shop of any changes to the Delivery Address or Conditions, International Beer Shop takes no responsibility for incorrect delivery of goods. You then are liable for any costs associated with the return or refunding of the delivered goods.

If the quoted fee for the delivery is insufficient to cover the actual delivery charges, then International Beer Shop is not obligated to fulfil your order. If a decision is made not to absorb the additional costs, International Beer Shop will notify you and offer you the option of paying the difference and going ahead with the order. You will have the option to proceed and pay the higher delivery fee or cancel the order.

Any delivery timeframes quoted on this web site are a guide only. You acknowledge that a risk exists that an order will not be delivered within any timeframe quoted.

Risk and title of the goods passes to you upon delivery of the goods to the Delivery Address.

Returns/Refunds

If at any time you’re not satisfied with the quality of the purchased goods, you may;

Price of Goods

All prices are as specified on the website Product List and include the nominated delivery any handling fee. Prices quoted are all subject to change and verification upon receipt of the order by the International Beer Shop. The price payable for the goods shall be the price applicable on the date the goods are confirmed ordered.

Acceptance of your Order

Once you have made your choice and your order has been placed, you will receive an email acknowledging the details of your order. This email is NOT an acceptance of your order, just a confirmation that we have received it. Unless you cancel your order, acceptance of your order and completion of the order between you and International Beer Shop will be completed when the goods have been dispatched. We reserve the right not to accept your order in the event, for example, that we are unable to obtain authorisation for payment, that shipping restrictions apply to a particular item, that the item ordered is out of stock or does not satisfy our quality control standards and is withdrawn, or that you do not meet the eligibility criteria set out within the Terms &Conditions.

We may also refuse to process, and therefore accept a transaction for any reason, or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any merchandise from the Site whether or not that merchandise has been sold, removed, screened or edited from the content on the Site, refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

Payment

Payment can be made by Visa, MasterCard and any other methods which may be clearly advertised on the Site from time to time. Payment will be debited and cleared from your account upon dispatch of your order by International Beer Shop. You confirm that the credit/debit card that is being used is yours or that you have been specifically authorised by the owner of the credit/debit card to use it. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to International Beer Shop, we will not be liable for any delay or non-delivery.

Packaging/Labelling

The International Beer Shop aims to supply up-to-date pictures of all the beers available on our Product List. At times some of the pictures of goods, may differ from the goods actually supplied. International Beer Shop does not warrant the accuracy of the information contained in the Product List. It is therefore recommends that you read the labels on goods prior to any consumption.

Licence/Intellectual Property

The International Beer Shop grants you the authority to use our website to find information on products and for the purchase of goods. You acknowledge that you are not permitted to use the International Beer Shop website for any other purpose without express written authorisation.

Security

Notification of Changes

The International Beer Shop may revise or delete, or otherwise change any of the Terms of this Agreement.

You agree to review all the Terms & Conditions of this Agreement prior to placing each and every order.

Any use of the International Beer Shop services will constitute your deemed acceptance of such changes.
